With the increasing prevalence of design-build as a preferred method of project delivery, it’s more important than ever for practitioners use standard contracts with appropriate risk allocations that are widely used in the industry.  To do so is key both to profitability and proper risk management, regardless of whether your firm is serving as a design-builder, as an engineer subcontracted to a design-builder, or as a consultant assisting an owner with implementing design-build.

The Engineers Joint Contract Documents Committee (EJCDC) will release its 2016 Design-Build (“D Series”) Documents in May 2016.  Participants of this presentation will receive an overview of the significant changes made by EJCDC, compared with prior editions of the D-Series, and the many new documents added to the D-Series, including a new template for Requests for Qualifications (RFQ), a template for Requests for Proposals (RFP), and a new form for submittal of pricing proposals, a brand-new, comprehensive guide for preparing Supplementary Conditions, a Teaming Agreement, and the industry’s first standard “progressive” design-build Agreement.  The significant changes to EJCDC D-700, Standard General Conditions for Design-Build Projects, will be presented, together with changes in the other, existing D-Series documents.

The session will highlight the benefits of using these documents, which are now the industry’s state-of-the-art for design-build contracts.

As a result of attending this presentation, participants should be able to:

  • Explain and apply the concepts associated with using EJCDC’s new design-build RFQ, RFP, and Proposal documents.
  • Recognize the benefits and use of EJCDC’s industry-first standard Agreement form for implementing “progressive” design work.
  • Understand the 2016 changes in risk allocations and design-build procedures presented in the 2016 EJCDC Standard General Conditions for design-build contracts and its new, associated Supplementary Conditions.
  • Explain why EJCDC’s 2016 D-Series is the state-of-the-art in design-build contracts.
  • Understand the use of and risk allocations in the other documents of EJCDC 2016 D-Series.
