This program will review current trends and challenges Design Firms face specific to negotiating contracts.  We will review specific clauses along with advice on how firms can effectively negotiate their agreements to avoid taking on uninsurable risks.  This program will also review current claim trends and why Design Firms need to “hold their ground” when it comes to certain contract provisions.  We will review “Deal Breakers and Makers” that every firm should consider and share some tips and tools A&E’s can use including contract review checklists, terms and conditions as well as go/no-go procedures.  This is an excellent program for anyone that is responsible for negotiating contracts, managing risk and/or managing client expectations.

  • Discuss the challenges faced by the design community by poorly drafted contracts.
  • Provide specific examples of contract clauses frequently appearing in contracts, and their impact on the potential for claims.
  • Discuss risk management techniques to address particularly bad contract language.
  • Discuss negotiating techniques in coming to agreement on contract language.
